THE GOVT FARMERS BILLS : THE REAL STORY

 Hi All,

I don't know the identity of the writer of article below. As some are wont to declare in a huff, it may be even be the handiwork of someone in a Govt Dept/or the ruling party! I am still forwarding it only because I agree with the purpose of these bills - to free the real farmers from the clutches of the middlemen and to give the farmers the freedom and choice to  select whom to sell their products to. 

I sincerely hope that this aim is achieved, despite the political protests on the streets of some states. Whatever be, change is the essence of life and I feel this is the correct thing to do!  Moreover, Modi is too smart a person to commit harakiri by angering the real farmers of rural India.

I was in school when late PV Narasimha Rao opened up India to foreign companies and industries. Then there was a huge furore that we will be enslaved by foreign companies like that of East India company once again and we will become Ghulams of foreigners. Leading the pack who protested were Indian companies like Bajaj who had a monopoly on two-wheelers and Hindustan Motors(Ambassador which was the only car available) and then the usual suspects like Communists (they were still powerful in those days) Workers' union leaders and media.

I never understood why we should protest when we are getting Fords, Hondas, to the Indian market as it will create more jobs and give us better cars than those horrible Ambassador cars. I was like we should also start growing like China and Korea.

But Dad said we are protesting as we are afraid of the unknown. We are content staying poor and malnourished with the so-called Hindu Rate of Growth.

The protests went on all 5years during PVNR rule and he eventually lost after 5 years.

Today everyone says he is the man who truly liberated India and today if we are 5th biggest Economy, it is due to his policies.

The same thing happened when computers came to India.

They said it will take away jobs & everything will be controlled by software companies. But today India is a Software Powerhouse and it has created millions of jobs.

Now Agriculture Reforms are happening after 74 years of independence. 1st time farmers will be free from the clutches of middlemen and dalals.

It is middlemen who become millionaires in India while farmers are always in debt & the consumers land up paying more & more for food and commercial crops every year.

These middlemen are so powerful people that they form the backbone of many parties like NCP, Akalis, Punjab congress, and many other regional parties. Hence no one tried to tamper with Agriculture Market Reforms. Once when Indira Gandhi was told to control these middlemen, she quipped back "Should we stop contesting elections!!"

Many of my family members and relatives are in controlling positions in APMCs and they are all crorepatis.

Many of my family members and relatives are farmers and I have always seen them only struggle in their lives.

Once I met a famous professor at MIT who was working on the National Agriculture Market (NAM) in India where the Indian govt had asked him to design an All India model to connect all the markets of India.
His team worked on it for two years and told the govt we can’t create a NAM until we allow farmers to sell in an Open Market. He told me the same and said in 2018 that Modi Govt if it wins in 2019, will bring in huge Agricultural Reforms in the second term which will double or treble the farmer income and since they make 60 percent of the Indian population

*And this will truly transform India.*

Hence, I was rooting for Modi to come back and bring these reforms.
These agricultural reforms are bigger than what PVNR did in 1991.
India will truly become a middle-income country as more and more people will get fruits for their labour.

Yes, many farmers are apprehensive. They say MSP will go and hence it is a loss.

The govt will continue MSP and mark my words after a few years no one will need MSP as farmers will be selling to the best market and making more money than MSP.

They say big corporations will monopolise and control farming.

Same was told when GM, Ford,Toyota & Honda came or when McDonald’s or KFC came.

But the fact is GM ran away from India and Maruti Motors controls 51 percent market share and Honda has 3 percent.

The same way Market forces and proper Regulations will never let someone control the whole farming. It is too big, too diversified for any company to do it.
And most importantly the Digital Tech and Artificial Intelligence will transform market intelligence send make every farmer access to any good market without selling it to dalals or a big company.

Now the democracy has truly reached Agriculture and farmers have got their independence.

Dear friends a lot is being discussed about Farmers Bill... The issue was always that the farmers were not getting the right price... The farmers were dependent on the MANDIS which were controlled by the politically powerful families... this bill will stop that...

*FRIENDS IT IS VERY IMPORTANT TO SPREAD THIS MESSAGE... IF WE CAN’T COMMUNICATE THE RIGHT MESSAGE TO THE NATION... DEMOCRACY IS USELESS....*

One of the foremost and first Farmer Friendly Step has been taken by this Government in this Monsoon Session.
*APMC Act is one of the most transformative reform in Agriculture post-Independence.*
Two Bills on this legislation are passed in Lok Sabha, soon it will be an Act.

After this, Farmers will be allowed to sell their crops to the best buyer. Whosoever will purchase crop at the highest rate will buy directly from Farmer.

*Farmers will now not be forced to sell it to Mandis.*

Politicians who are playing Politics especially the Akali Dal is just because they have huge Nexus in Mandi and Procurement of Crops!

Similarly, the Yadavs have a stake in Sugar Cane Producing Farmers similar to the Pawar Family in Maharashtra.

*Politicians like Mulayam Singh Yadav, Badal Family, and Pawar Family have looted Farmers most by purchasing crops at low rates.*

Now Farmers are Free. Commercialisation and Corporate Farming will now increase competition and Farmers will be benefited the most.

Many Agro-based Start-Ups are coming and already working in linking Farmers directly to customers bypassing Mandis.
Mandi Politics is over and three years back, All Mandis have been made Digital by E-NAM Project and there too it is mandated to allow Farmers to sell product by Bidding.

*PM Narendra Modi is working on Farmers Improvement for the past 6years and it is his constant and consistent effort that now Farmers are truly Independent and Now they don’t need to Do 'जी हुजूरी' of Politicians.*

Kudos to the PM.

My only advice to everyone, don’t get misinformed and Explain to people.

I know these Political Drama Planners will do Drama but they knew this for a year,
Why Resignation Drama now ?

UPDATE ON e-PPOs: LATEST

 Approx 70,000 e-PPO w.r.t Airmen & NCs(E) and 4,000 e-PPO w.r.t Officers have been uploaded on Dte Civil website. The same have been forwarded to your respective banks through a secured link established. 

 Database submitted by Air Veterans in hard copy and online form had already been handed over to O/o PCDA (P) / O/o JCDA (AF) for issuance of e-PPO. 

 A dedicated team has been formed at DAV and O/o PCDA (P) Prayagraj /O/o JCDA (AF) Subroto Park to facilitate early issuance of e-PPO. 

 Weekly meetings are being held at the level of Addl CDA / O/o JCDA to remove the impediments for smooth implementation of e-PPO project.

DAVs endeavor is to complete the task of issuing e-PPOs to all Air Veterans & Family Pensioners by 31 Dec 20.

Sub: Revision of Regulation relating to rate of Family Pension (Normal rate & Enhanced rate) of Pension Regulation for the Army, Part-1 (2008) in the line of amendment done in Sub Rule (3) of Rule 54 of CCS Pension Rule, 1972 by DoP&PW-reg,

Sir,

The undersigned is directed to refer to the provision of Note 3 (i) & (ii) below Army Instruction 51/80 and Regulation 64 (b) in Pension Regulation for Army, Part-I (2008) under_which the minimum of 7 years of continuous qualifying service is required for grant of enhanced rate of Family Pension for the Armed Forces personnel.

2. Consequent upon issue of Gazette Notification No 550 dated 19.09.2019 of the Ministry of Personnel, Public Grievances & Pensions, Department of Pension and Pensioners’ Welfare (DoP&PW), the condition of minimum requirement of 7 years of continuous service for grant of enhanced rate of Ordinary Family Pension in the sub rule (3)(a) & (b) of Rule 54 of CCS Pension Rule, 1972 has been deleted w,e,f 1st October, 2019 and now Government servants who died in service/invalided out even with less than 7 years of qualifying service shall be eligible for enhanced rate of Family Pension. This notification also has a provision where a Government servant who died within ten years before the 1st day of October 2019 without completing continuous service of seven years, his family shall be eligible for family pension at enhanced rates in accordance with sub rule (3) with effect from the 1st day of October 2019, subject to fulfillment of other conditions for grant of family pension.

3. Now, the President is pleased to decide that the same provision shall be extended to Armed Forces Personnel also. Accordingly, the clause “after having rendered not less than 7 years continuous qualifying service” of Regulation 64(b) of Pension Regulations for the Army, Part-I (2008) stands deleted w.e.f. 01.10.2019.

4. It has also been decided that where an Armed Forces Personnel died within ten years before the 1st October, 2019 without completing continuous service of seven years, his family shall be eligible for ordinary family pension at enhanced rate as per Regulations 64(b) of Pension Regulations for the Army Part-I(2008) with effect from the 1st October 2019 subject to fulfillment of other conditions for grant of Ordinary Family Pension.

5. Further, the provision of Army Instruction No. 51/1980 would stand modified upto this extent w.e.f. 01.10.2019. The regulation and their instructions for grant of Ordinary Family Pension in Navy and Air Force shall also be amended accordingly.

6. This issues with the concurrence of the Finance Division of this Ministry vide their ID No. 10(02)/2020/FIN/PEN dated 23.09.2020.

Update on OROP case hearing in HSC as on 01 Oct 20

 OROP case in HSC was listed at S no 26 in virtual court 4 in SC in the court of

Our turn came at 1330h, ASG Mr N Venkatraman requested the court that this is a very important case and Govt has submitted a consolidated Affidavit as per direction of the court. He further requested that Attorney General of India would like to argue this case but he is not available today and hence a date may be given by the HSC.

Justice YV Chandrachud accepted the request of ASG and gave a short date of 28 Oct 2020 Wednesday. He further stated that we will have final arguments on next date and decide this issue.

ASG Mr Narasimhan put across the point that 75% of defence budget is earmarked for pay and pensions. He further stated that comparison charts given by petitioners are not correct.

Mr Hujefa our lawyer strongly put across that the consolidated affidavit submitted by GOI confirms that Govt has given one rank many pensions (ORMP) in place of OROP. Mr Hujefa confirmed that charts submitted by petitioners are correct and we will prove it in next hearing. Mr Hujefa further stated that a great injustice is being done by Govt to veterans by not fulfilling OROP in its true spirit.

Mr Balaji Srinivasan requested that petitioners may be permitted to file a reply to consolidated affidavit of GOI. Justice Dr Chandrachud accepted this request and ordered that reply may be filed by 21 Oct.

Next date for hearing in HSC is 28 Oct 2020 Wednesday.

HC MUMBAI'S JUDGMENT OF 20 AUGUST 2020 ON PROTECTION OF PENSIONS OF THE VETERANS (SHARED BY MR. PARVEEN KOHLI)

EXTRACTS OF THE JUDGMENT....

14. The Bank is a trustee of the account of the pensioners, like the petitioner, and has no authority in the eyes of law to dispute the entitlement of the pension payable to the employees, other than those in the employment of the Bank. To tamper with such account and effect the recovery of pension without any authority, is nothing but a breach of trust of the petitioner by the Bank. We should not be understood to have said that even where there is technical error in calculation, other than of entitlement, is committed resulting in excess payment, the Bank cannot recover it. We have already held that no such case is made out here.

16. Before parting with this Judgment, we need to remind the Bank that the pension payable to the employees upon superannuation is a ‘property’ under Article 300-A of the Constitution of India and it constitutes a fundamental right to livelihood under Article 21 of the Constitution of India. The deprivation, even a part of this amount, cannot be accepted, except in accordance with and authority of law. Article 41 of the Constitution of India in the Part IV of Directive Principles of State Policy has created an obligation upon the State to recognize a right of public assistance in the case of old age, sickness and disablement. Article 46 therein requires the State to promote with special care the economic interests of the weaker sections of the people. In short, the aforesaid provisions of the directive principles of State policy create an obligation upon the State to enact suitable laws, making the provisions to recognize a right of public assistance, to promote economic interests, to protect the life and property of senior citizens, to treat them with respect and dignity and to give wide publicity to it.

17. Unfortunately, the time has come to tell the Bank that the aging is natural process, which leads to weakening of the body and mind. The productivity, working ability and mobility decreases or paralyzes with growing age. The traditional norms, values and culture in the Indian Society demand to treat the senior citizens with respect, dignity and lay stress on providing security, care and assistance to them. It becomes a part of the human right of the senior citizens. The senior citizens are the persons who had shouldered the responsibility of building a nation in general and society or community in particular, while in service. Utilizing their experience in the life and working, the strong shoulders are created of young persons to substitute and rest the responsibility upon them, while demitting the office. The bank officials must realize that tomorrow it may be their turn, upon superannuation, to fight for the pension or post-retiral benefits. The thought process, therefore, to be adopted should be of a person in a situation like the petitioner. The respect, dignity, care, sensitivity,
assistance and security would automatically follow.

18. We have, however, seen and can take judicial note of the fact that the security of the senior citizens always remain in peril. We have seen the senior citizens anxiously waiting for credit of the pension amount in their account and standing in a queue for withdrawal. Once the amount is withdrawn personally either from the Bank or from the ATM, a serious threat starts posing to the life from the watchdogs roaming around involved in pick-pocketing and stealing. We have actually seen the old aged persons – men and women, counting the currency with cramping hands and trying to secure the amount at some hidden place in the body. It is then after waiting in the premises of the Bank and taking stock of the situation and the atmosphere with scared mind and the feeling of insecurity, the escape route and time is chosen to reach to their destination safely. It is a high time for the Banks to create a separate cell and to device a method to provide personal service through the men of confidence, at the door-step to the old aged, disabled and sick persons who are the senior citizens. They have to be treated with respect and dignity. The sensitivity to the problems of the senior citizens need to be addressed. The mechanism for immediate redressal of grievance needs to be provided. The officers having a degree or master’s degree in Social Work or Psychology, who can be in personal touch with and genuinely understand and redress the grievances or complaints of the senior citizens, can be appointed.

19. In the result, this petition is allowed and the following order is passed :

(1) The action of the respondent No.3- Bank in deducting an amount of Rs.11,040/- per month with effect from October, 2019 is hereby quashed and set aside.

(2) We direct the respondent No.3- Bank to immediately credit an amount of Rs.3,27,045/-, recovered from the pension account of the petitioner, along with interest at the rate of 18% per annum from the date of recovery of each of the installments, till the date of credit of this amount in the pension account of the petitioner.

(3) The respondent No.3- Bank is restrained from recovering any amount from the pension payable to the petitioner on the basis of the action, which we have quashed and set aside.

(4) We direct the respondent No.3- Bank to pay the compensation of Rs.50,000/- to the petitioner and credit the said amount in the pension account of the petitioner within a period of eight days from today, failing which the additional costs of Rs.1,000/- for each day’s delay will have to be paid.

(5) We direct the Registry of this Court to forward the copies of this Judgment to the Centralized Processing Pension Centres of all the Nationalized Banks and also to the Reserve Bank of India and the Chief Secretary, Government of Maharashtra, to consider the question of constitution of separate cell and release of appropriate guidelines so as to attain the constitutional goal of providing respect, dignity, care, sensitivity, assistance and security to all the pension account holders in the Banks.
