PENSION ELIGIBILITY FOR RESERVE PERIOD - ARMED FORCES PERSONNEL

Dear Friends,

Please read the email received from AVM RP Mishra appended below. Please also read the attachment. Kindly do your utmost to give wide publicity to the contents of the attachment, as it affects very large number of sepoys, ratings and airmen from all Three Services. The ESM organisations should make copies of the attached ORDER 12.01.2011 of Armed Forces Tribunal, Principal Bench at New Delhi, display it at prominent places under their jurisdiction and distribute copies to reach every possible city and village.

    Greetings from Chennai.Please let me know if i would be eligible for pension under this judgement.I was discharged from IAF on own request after 13 years of service + 2 years reserve service.

  2. Does this affect pension eligibility of SSCOs as even they are on reserve liability for 05 years thus taking their service period to a total of 10 year duration(05 year active duty plus 05 years of reserve liability). As per Central Civil Service Pension Rule 49(2)(b) a civilian equivalent qualifies for full pensionable service after putting 10 years of service. With this reference does this merit a case under Fundamental Right to Equality as even military service is a Central Service.

      sir i served in indian airforce from feb 1970 to feb 1979 and discharged with 9 years service and 6 years reserve period and re employed in a national bank in 1983 without getting basic pay amendments and retired after completing 29 yrs of service in 2012 neither i get the benefits of service pension nor full pension of bank which was on prorata ,now i am requesting u to advise me am i eligible for reservist pension or benefit of bank pensions

  4. Sir,

    My father served with IAF for 9 years and was in reserve for the following 6 years. He served when in reserve for 59 days immediately continuing after his end of nine years of service. During the rest of the reserve period he did not get any call from IAF to serve. Please let me know if he will get pension under the above order.

    1. Yes. You are eligible for reservist pension as per some of the AFT judgements.Check and write to DAV first and then file a case in AFT

  7. sir my grandfather discharge from own request from army after completing 5 years in 1976 after he join DSC and also do 7 years service the net service becme 12 years can he eligible for reservist pension none of the pension started this case below 1980

  8. My father served in the Indian Navy from June, 1963 to October, 1974. He was of the opinion that he would be covered under special pension, but he received information that it is applicable for those who were discharged on or after 03 July,1976. He has served for more than 10years and is not receiving any pension so far. Please could you advise on how we could ensure that he gets his due pension. Your help and inputs are greatly appreciated. Thanks again
