Sixth Pay Commission to apply on pre-2006 retirees also: CAT

In a relief to senior citizens, who retired from government service before 2006, the Central Administrative Tribunal (CAT) has directed the Centre to re-fix their pension on the basis of recommendations of the Sixth Central Pay Commission (VI CPC).

The order will provide relief to thousands of such retired government servants whose pension would increase substantially. A three-judge bench of CAT headed by its Chairman Justice V K Bali quashed the August 29, 2008 government resolution which amended the recomendations of the sixth pay commission due to which the pre-2006 retirees were getting lower pension than the post 2006 retirees. The bench passed the orders on a bunch of petitions filed by individuals, their association -- Central Govt. Pensioners Association -- claiming pension at par with post-2006 retirees on the recommendations of the VI CPC, which took effect from January 1, 2006.

  1. Nice to hear this, however, plese confirm whether this package is also be given to ex-defence Armed force ex-service personnel.

  4. The desion should to applicable to defence personnel ,bcoz
    the pay commission is sameone ,and we should aall fight for it,all orgonization should come together &give a brave fight.

"Prior to 01-01-2006 (6th CPC), pension in respect of ranks from Sepoy to Sub Maj was calculated based on the top-end (maximum) of the scales rather than the bottom as was applicable to Commissioned Officers and civilian retirees. After the 6th CPC, the service pension calculation formula for all ranks and services was changed to 50% of minimum of pay band + Grade Pay (GP) + Military Service Pay (MSP) + X Group Pay (where applicable) while the formula for family pension was 30% of the same above mentioned components."
    IS IT NOT THAT THE CAT HAS CLEARED THE WAY FOR IMPLEMENTATION OF 6 CPC APPLYING CONDITION FOR CIV PRE-2006 PENSIONERS.THAT IS GRANTING FULL PENSION FOR 20 YRS SERVICE. THE SAME CAN BE APPLIED FOR DEFENCE PENSIONERS GRANTING FULL PENSION FOR 15 YRS SERVICE FOR PRE-2006 DEFENCE PENSIONERS.

    Will the Minister of FINANCE be pleased to state:-
    (a) Whether Government has plans to increase dearness allowance effective from January, 2011 for Central Government employees with a rate that commensurate with the inflationary trends and plights of working class in the past few months;
    (b) If so, the details thereof and if not, the reasons therefore;
    (c) Whether Government has any proposals to declare DA as Dearness Pay when it will cross 50 per cent, as it was done during the 5th Pay Commission;
    (d) If so, the details thereof; and
    (e) If not the reasons therefore?
    ANSWER
    MINISTER OF THE STATE IN THE MINISTRY OF FINANCE (SHRI NAMO NARIAN MEENA)
    (a)&fb): Increase in Dearness Allowance payable to Central Government employees with effect from January, 2011 will be worked out on basis of accepted formula which is based on the recommendation of 6th Central Pay Commission.
    (Ch (d) & (e): No proposal to declare DA as dearness pay, after DA crosses 50% is under consideration of the Government. The Sixth Pay Commission did not recommend merger of dearness allowance with Basic Pay at any stage. Government accepted this recommendation vide Government of India Resolution dated 29.8.2008.

    IN 6th CPC VARIOUS ALLOWANCES FOR SERVING HAS BEEN HIKED BY 25% ON ATTAINING DA AT 50%
    SO IT IS GREAT INJUSTICE TO PENSIONER AS DA HAS REACHED 50% BUT NOT ADDED AS DP AS IN 5th CPC.ANY LOGIC PLEASE FOR THIS VARIATION
