1.   IESM  SOP regarding “Measures for the benefit of Armed Forces Veterans, War Widows, their dependents and Veer Naries” is enclosed herewith.

2.  You are requested to circulate the information regarding award of Scholarships to the dependents of War widows, widows and veterans of Armed Forces as per the SOP. Applications are sought from eligible members of the Defence Family for the award of scholarships.  Application may please be forwarded to Indian Ex servicemen Movement (IESM) HQ at 543 Sector 23, Gurgaon -122017 (Haryana) by 10 Aug 2019 positively.

3.         Financial Assistance to seven widows of ex servicemen Rs 15,000/- each has already been given as under:-

MEASURES FOR THE BENEFIT OF ARMED FORCES VETERANS,
WAR WIDOWS, THEIR DEPENDENTS AND VEER NARIES

  1. Indian Ex-servicemen Movement is one of the prominent societies in India which have been formed with a solitary aim of helping veterans, veer-naris and their families. IESM has spearheaded the fight of OROP for veterans and has succeeded in getting OROP for veterans and their families. There are some anomalies still to be resolved and fight for removing these anomalies is going on. IESM has started a new initiative to help veer-naris and their families. There is no doubt that our soldiers have fought for the country and have given supreme sacrifice for mother land, but their families have not got the recognition, by the Government, which they deserved for the supreme sacrifice given by their husbands.
  2. Creation of a corpus Fund: IESM: IESM has been recognized in corporate sector as one of the pioneer organization which is spearheading welfare measures for veterans, veer-naris, their families and citizen of India. Corporate houses have started contributing funds, reserved as corporate social responsibility (CSR) to IESM for this purpose. Recently one of the corporate has contributed Rs 25 Lakhs to IESM for the welfare measures of veterans, veer-naris and their families. It is recommended that IESM should allot equal amount of Rs 25 lakhs and make the corpus fund of Rs 50 Lakhs for the purpose. Administration of this fund is recommended to be done in such a way that corpus fund is increased every year from inception.  
  3. Topping up of Corpus Fund: Corpus fund will be topped up to slowly to Rs One crore in next ten years provided IESM gets increased donation per year.
  4. Financial Assistance: It is proposed that IESM establishes
    1. Scholarships for 4 girls (students from class 6 to 12th class) and one boys (students from class 6 to 12th class) at the rate of Rs 12000/ per year to be paid in Oct and then in Apr of each year.  Total Rs 0.60 Lakhs per year for a period of seven years. Number of scholarships will increase every year and will become constant 35 students (28 girls and 7 boys) in eighth year. Amount of scholarship in eighth year will be 4.2 Lakhs per year.
    2. Scholarships for professional studies (Students in professional colleges Engg/Medical/Management/Masters degree) at the rate of Rs 24000/ per year for 3 students (2 Girls and 1 boy). Total Rs 0.720 Lakhs per year for a period of four years. Number of scholarships will increase every year and will become constant 12 (8 girls and 4 boys) in fifth year. Amount of scholarship for professional studies will be Rs 2.88 lakhs per year from fifth year onwards.
    3. These scholarships will be named after PVC winner and Field Marshal/Marshal of Air Force from 1947 onwards.  
    4. Financial help to veer-naris who wish to start their own cottage industry in form of helping them to buy the machinery for starting up. This could be Rs 50000/ per veer-nari for three veer-naris. This could also start from 2017.  Total Rs 1.5 Lakhs.
    5. Financial help to old age home/orphanage in civil at the rate of Rs 5000/ to ONE establishments.  Total Rs 0.05 Lakh.
  5. Administration of the Corpus fund:  It is recommended that funds may be administered as given below. For the purpose of explanation, we presume that corpus fund available is Rs 50/ lakhs. 
    1. Total corpus fund at disposal                                   Rs 50 lakhs
    2. Interest from the corpus fund @ 7%                       Rs  3.5 Lakhs
    3. Expected donations every year for first 3 years        Rs  5.0 Lakhs
    4. Expected donations every year for 4th year onwards Rs 10.00 lakhs  Recommended scholarships/monetary help amount     Rs 1.32 Lakhs per year.
    5. Recommended for veer-naris to start their own                               Rs 1.5 Lakhs per year
    6. Recommended for old age homes/orphanage in civil    Rs 0.05 Lakh per year
  6. Year wise out go of funds
    1. Balance available at the end of first year as corpus fund               Rs 50 Lakhs –(0.12*5= 0.60)-(0.24*3=0.72)-1.5-.05+5+3.5= 55.63 Presuming we get donation of Rs 5 Lakhs in first year.
    2. Balance fund available at the end of second year       Rs 55.63-(0.12*10=1.2) –(0.24*6=1.44) -1.5-0.05 +5.00 donation of year + interest Rs 3.5 Lakhs = Rs 59.94 Lakhs
    3. Balance fund available at the end of third year                       Rs 59.94-(0.12*15=1.8)-(0.24*9=2.16)-1.5.0-0.05+ 5.00  donation of year  + interest  Rs 3.5 Lakhs= Rs 62.93 Lakhs
    4. Balance fund available at the end of fourth year Rs 62.93-(0.12*20= 2.4)-(0.24*12=2.88)-1.5-0.05+ 10.00+3.5= Rs 69.6 Lakhs

    11. There after outgo will remain fixed at Rs 8.63 Lakhs per year for scholarship of 47 students (36 girls and 11 boys per yr and Rs 1.5 lakhs per year as help to widows to start their own business and Rs 5000 for civil orphanage or house for senior persons.
    12. Scholarships to needy students can be increased in number as well as amount from 11th year for secondary school students. Recommended increase in number is to 40 from 35. Recommended increase in amount is Rs 1500 from existing Rs 1000/ per month for secondary school students.
    13. Scholarship to needy students can be increased in number as well as amount from 11th year for professional studies. Recommended increase in number 5 from existing 3 students. Recommended increase in amount is to Rs 3000/ from existing 2000/.
  7. Criteria for Selection; It is very important to select suitable candidates. Following criteria are decided for selection of deserving candidates.
    1. Scholarship for secondary schools.
       i.      Application for the scholarship must be countersigned by two members of IESM and convener of the district.
          ii.      Application must be signed by class teacher and countersigned by Head Mistress/Principal.
         iii.       Application must be accompanied by PPO, Aadhar card, Identity card of the school. Mark sheet of previous class five.
          iv.      Application duly completed must reach IESM head office latest by 1st Oct of the year.
           v.      Students are to be daughters/son of a widow or economically poor soldier.
          vi.      Student should not be getting any more scholarship.
         vii.      Student should have more than 80% marks in previous class.
      viii.      Student should have scored 80% marks in the class for him to qualify for next year scholarship.

    1. Continuation of Scholarship for next year.
       i.      Application for the scholarship must be countersigned by two members of IESM and convener of the district.
         ii.      Application must be signed by class teacher and countersigned by Head Mistress/Principal.

     vii.      Student should have more than 80% attendance in school.

    1. Continuation of Scholarship for next year for professional course scholarship.
   i.      Application for the scholarship must be countersigned by two members of IESM and convener of the district.
    ii.      Application must be signed by Principal of college.
  iii.       Application must be accompanied by PPO, Aadhar card, Identity card of the school. Mark sheet of previous class.
 iv.      Application duly completed must reach IESM head office latest by 1st Oct of the year.
  v.      Student should not be getting any more scholarship.
  vi.      Student should have more than 80% attendance in school.
 vii.      Student should have scored 80% marks in the previous class for him to qualify for scholarship for next year.

  1. Discontinuation of Scholarship. Scholarship will be discontinued in following cases.
    1. In case the student is expelled from college on discipline grounds.
    2. In case the student is involved in any illegal activity involving any FIR by police.
    3. In case the student is involved in any anti national activity.
    4. In case the student is involved in ragging activity of juniors.

  2. Committee for Recommendation. It is recommended that GB will approve the names of members of committee to discuss and approve the financial assistance to veernaris and students. However some recommended names are

FORWARDING OF PPOs IN R/O 2019 RETIREES OFFRS/JCO AND ORs


Dear All Veterans

1.         The next hearing of OROP Case in Hon’ble Supreme Court is on 06 Aug 2019. IESM team is ready with strong arguments to present veterans' case. IESM has had a meeting with Honourable RM Sh Raj Nath Singh on 1 July 2019 and explained the anomalies of OROP. However no solution has come from MOD so for. 
2.        You are all aware that CGDA is attempting to put a spoke in OROP by quoting a false information that present day retirees of 2018/2019 are getting less pension than old retirees (post OROP) of 2013/2014. MOD counsel is likely to extend this argument in HSC on 6 Aug. This needs to be countered in following ways. 
        (a)    Legally it is not possible to reduce pay of any Government employee, hence if pension of 2018/19 retirees is less than pension of 2013/14 retirees that means that pay of 2018/19 employees of any rank is less than pay given to 2013/14 employees of similar rank with similar years of service. This means that present day employees of 2018/19 are getting less pay than what they deserve and hence it can be challenged. However if there is an isolated case because of some special reason that can be explained. But it cannot be quoted as an example to deny past retirees their genuine dues. 
        (b)        IESM will be able to call bogie of CGDA with  EPPO (of 2013/14 and earlier and also of 2018/19) in our hand to convince HSC that CGDA/DESW/MOD are attempting to deny genuine dues to Armed Forces Personnel by misquoting the information to HSC. These PPOs are not available with us as of now. 
(3)        IESM has also read the interpretation of Brig Vidyasagar and is in agreement with him that CGDA is attempting to cancel already approved OROP rather than equalising it in July 2019 as per Govt letter dated 7 Nov 2015.
(4)        Veterans are aware that IESM plea is that five year equalisation is not acceptable as it is putting past retirees at loss for five years and hence equalisation must be done every year. 

IESM therefore needs these PPOs to strengthen our arguments for hearing on 6 Aug. 
In view of above all veterans are requested to send PPOs ( 2012/13/14 and 2018/19 period)

OROP RTI INFORMATION

Sub: Re-fixation of pension under OROP - reg

        Ministry may kindly refer to their ID No.1(1)/2019/D (Pen/Pol) d/d 28.03.19 forwarding a copy of TRIPAS letter No.C/7026/VII CPC/84/OROP d/d 11.03.19. However, copy of ibid TRIPAS letter has not been found enclosed. It is requested to kindly forward the same.

2.     Further, vide Para 3 of ibid ID, Ministry has requested to start preparatory work for re-fixation of pension under OROP as per para 3(v) of MoD letter dated 7.11.2015. In order to begin work, Ministry is requested to clarify the following:

(a)   W.r.t. Para 3 of GoI, MoD letter dt. 7.11.15, it may be confirmed whether the same methodology is to be employed for calculating OROP rates viz. average of minimum and maximum pension. If so, the year from which data of current retirees is to be used may be specified. 

(b)   OROP was implemented w.e.f. 01.07.2014. Similarly date of effect of this next round of revisions may kindly be intimated.

(c)    It may be recalled that several issues and anomalies regarding OROP implementation has been raised earlier. Government has referred three (03) major categories of these issues to a One Man Judicial Commission appointed vide No. 12 (1)/2014-D (Pen/Pol) d/d 14.12.2015. Various ESM associations had also made reference to this OMJC. The report of OMJC is pending with the Ministry. It may be clarified whether any of the recommendations of the OMJC are to be factored into the new calculations.   

3.    It may be mentioned here that there have been several developments since the issue of OROP orders in 2015-16. The most significant is the implementation of the recommendations of the VIIth CPC. The impact of these recommendations with respect to revision of defence pensions was not factored into the OROP orders. As per the VII CPC orders, pension revision is to be undertaken by two methods and pension disbursed by the more beneficial of the two. The first method requires multiplication of pension as on 31.12.2015 by a factor of 2.57. This has been done by PDAs. The other method requires notional revision of pay across subsequent Pay Commission scales to arrive at a notional pay (and pension) under VIIth CPC scales. This revision has raised the following issues:  

(a)   The notional pay formula brings all past pensioners to current rates, almost as if they were serving under VIIth CPC. This is also the formula used in various Court judgments seeking to equate past pensioners with current retirees. For example, Hon’ble Supreme Court judgment in SPS Vains vs. UoI (2008) case and in DS Nakara case. As such it is a matter for consideration as to whether any logic exists to initiate the process of OROP revision once the pension of past and current pensioners has been equated w.e.f.1.1.2016.  

(b)  The notional pay based revision in respect of defence pensioners has just commenced. The final pension of past pensioners (as on 1.1.2016) is not available until this is completed. Therefore, data for comparing past pensioner with current pensioners is incomplete to that extent.

(c)   Ministry may also kindly refer to WP No. 419/2016 – Indian Ex-Servicemen Movement and others vs. UoI. While preparing to brief Ld ASG, Ministry had requested to compare pension under various Pay Commissions. The result was forwarded to Ministry vide this HQrs UO dated 23.08.2018 (copy enclosed). The sample study indicated that application of multiplication factor to OROP pension has created an anomaly whereby past pensioners are drawing higher pension that those who have retired between 1.7.2014 and 31.12.2015 and post 1.1.2016 retirees. It may be recalled that Service HQrs have also forwarded proposals citing this anomaly and seeking protection of pension of current retirees with respect to OROP pension. If this anomaly turns out to be widespread, the logic of revising pension of past retirees to bring them to the level of current pensioners would not subsist.  

4.   Ministry is requested to give directions of how to proceed further in view of the points mentioned above.

      Ministry may please refer to their above mentioned letter, calling for a comparative table indicating amounts of pension drawn under various Pay Commissions with reference to OROP.

2.   In this regard it is submitted that calculation has been made, as a representative sample, for two ranks of JCOs/ORs (Havildar and Naib Subedar) and two ranks of Commissioned Officers (Lt Col & Brigadier). The calculation sheet is attached as Annexure A & B for JCOs & Ors and Commissioned Officers respectively. 

3.   It is submitted that since 6th CPC, two revisions have been made for pre-2006 PBOR pensioners i.e. w.e.f. 01.09.2009 (CSC-2009) and 24.09.2012 (CSC-2012) with the intention to bring them at par with current pensioners. In addition, OROP benefits were given w.e.f. 01.07.2014. On analysing the data of post OROP pensioners, it is seen that: -

(a) Out of 668 retirees in the period 01.07.2014 to 31.12.2015 in the rank of Havildar, more than 20% of post OROP retirees are drawing pension less than OROP rate i.e. OROP pension is higher than pension of future retirees.

(b)  The difference is more prominent in the rank of Nb. Sub where more than 95% of post-OROP retired Nb. Subedars are drawing less pension than OROP rates.

(c)  More than 95% of post 01.01.2016 retirees in the rank of Nb. Sub draw less pension than the revised pension amount of OROP beneficiaries.

4.   This indicated that a significant proportion of post OROP retirees are getting less pension than past pensioners whose pension has been ameliorated as per OROP.
