APPLICATION FOR REVISION OF PENSION WEF 29/30.11.1989

I HAVE SENT THE FOLLOWING LETTER TO THE ADDRRESSEES BY E-MAIL JUST BEFORE.
I HAVE ALSO SENT CC MAIL TO AFVAI  CHAIRMAN, GEN SERCY & SOME OTHER EXECUTIVE MEMBERS, FOR INFO
NOW I REQUEST YOU TO SEND SEND A SIMILAR PETITION, BY FILLING IN YOUR PENSION PARTICULARS AT APPROPRIATE PLACES, SPECIALLY FROM 1996 ONWARDS.
MY OBSERVATION IS, THE PENSION FIGURE MENTIONED IN THE QS YERS AS AT COLUMN I.E. 24.5 YEARS (IN MY CASE) (18.5+6 YRS) IS THE CORRECT PENSION SHOULD BE GIVEN TO US. 
SO PLEASE SEND.

Respected Sir,
1.     I have the honour to inform you that I served the IAF from 19.5.1971 to 28.11.1989 in the trade of Clk GD (Gp III – now known as Gp Y). My last basic pay was Rs.1280/- in Nov 1989 and I was drawing 3 GCB pay @Rs.45/- (3x15=45), which was treated as Basic Pay for all purposes. Therefore, my total Basic pay as for Nov 89 was Rs.1325/-. But my pension was initially fixed @Rs.551/- for 18 years. Subsequently after adding 210 days boy’s service, my basic pension was refixed @ Rs.563/-pm. As per AFRO clarification and also PCDA’s SUVIGYA(for my total 18.5 yrs of QS), the Basic Pension fixed-@Rs.563/-pm w.e.f. 30.11.1989, RCP @ Rs.1730/-wef-1.1.96, RP-Rs.2595/-(50% DP merged) wef 1.4.04, RP Rs.1875/-(without DP) wef wef 1.1.06, RP-Rs.2812/-(50%DP merged) wef 1.1.06 (Table 62 of Cir.350),  RP-Rs.4239/-(Cir 397), RP-Rs.5647/-from 1.7.09 (Cir 430), RP-Rs.6108/-from 24.9.12/-(Cir 501) and lastly RP- @Rs.4775/-wef 1.1.06 (Cir.547).

2.    I may bring to your kind notice that my initial fixation of Basic pension itself was wrong and so are the subsequent revisions. My initial BP @ Rs.563/- was neither based on 50% pension formula of total pay (incl or excl of GCB) nor 50% of basic pay scale. (Rs.456/-or 640/-). The BP fixed seem to be @59.5% of my last basic pay i.e.1280x59.5/1000 x23.5/33yrs = 565/- which is nearer to Rs.563/-. Perhaps the the correct pension as per 75% of the pension formula (as per pension policy at the time of joining IAF on 19-5-1971) should havebeen –1280x75/100x24.5/33yrs =713/-or 1340x75/100x24.5/33yrs=746/-(incl GCB).Consequently my pension needs revision as given in the succeeding paras as per your changed pension policies.

3.  But surprisingly, my service pension was revised wef 1.1.96 @Rs.1730/-(Rs.563/- old pension), in terms of table attached to DP&PW OM F.No.45/86/97-P&PW(A)Pt II d/d 27.10.97 (applicable to CG Employees) and not in terms of AF Personnel Pension guidelines, which is beyond my comprehension and patently incorrect. The correct figure should have been –Rs.2177/-(Rs.713/-(old pension) and Rs.2296/-(Rs.746/-(old pension) wef 1.1.1996. However, it is a different matter as my pension was wrongly revised to Rs.1875/- as per Cir 350).   
4.   The GoI, MOD PBOR pension policy vide Order No. (1)/99/D(Pen/Services) d/d 7.6.99, was not at all beneficial which is reproduced for kind information:-
(a) Para 1, 2nd sentence (superseding all previous orders on the subject), states that wef 1.1.96, the pension of all Armed Forces Pensioners irrespective of their date of retirement shall not be less than 50% of the Minimum of Pay in the revised scale of pay introduced wef 1.1.96 of the rank and group (in case of PBOR) held by the pensioner. And the Minimum scale of pay wef 1.1.96 for Gp III/Sgt was – Rs.3775/- as per Special AFI 1/S/97(50% work out to Rs.1888/-).
(b) Para 2.2 (a) – Stated that – The revision of service pension in terms of these modified orders in r/o PBOR retirees will not be beneficial except for the rank of JCOs granted Hony.Commission of Lt & Capts, as the service pension is calculated at the maximum of the pay scale including 50% of the highest classification allowances, if any, of the rank and group which it is paid.
(c) Para 4- Further states – Where the revised and consolidated pension of pre-1.1.96 pensioners/FPs are not beneficial to him/her under these orders, and is either equal to or less than existing consolidated pension/FP under this Min letters dt. 24.11.97, 27.5.98 & 14.7.98, as the case may be, his/her pension/FP will not be revised to the disadvantage of the pensioner.
5.    If PBOR Pension policy (Para 2.2.) orders are not beneficial to PBORs and will not be revised to the disadvantage of the pensioners (Para 4), then what was the pension policy to revise pensions of 95% of JCOs/NCOs & ORs wef 1.1.96? But for some strange reason, what other methodology was adopted to revise PBOR pensions? 
     
6.    As per your Order No.14(3)/2004-D(Pen/Ser)/Vol III d/d 1.2.06, Para 2 – Finally GOM unanimously recommended that the pension of pre-1.1.96 retiree PBOR may be revised w.r.t. the maximum of post 1.1.96 pay scales. In addition, the weightage of Sepoy, Naik and Havildar ranks for past as well as future retirees be increased to 10, 8 and 6 years respectively, subject to a maximum QS of 30 years. The benefit would be given only in r/o service pension. It was mentioned in Para 3 that the Govt accepted the above recommendation of the GOM and the President was pleased to accord sanction to it etc.

(a) In Para 5, it was was added  after Para 2.2. (a) of your order d/d 7.6.99 relating to pre-&post 1.1.96 PBOR pensioners as – “ w.e.f. 1.1.2006, pension of pre-1.1.96 retirees of all ranks of PBORs in Army, Navy and Air Force for 33 years of QS shall not be less than 50% of the maximum pay in the revised scales of pay introduced wef 1.1.96 including 50% of classification allowance, if any, of the rank and group held continuously for 10 months preceding retirement subject to a minimum of Rs,1913/- pm. Such pension should be reduced pro-rata where the pensioner has less than the maximum QS for full pension i.e.33 years.
(b) Furthermore, Para 9 of above order stated – These orders are effective from 1.1.2006. No arrears are to be given. How strange?  When the anomaly is set right from 1.1.96, the payment of arrears flow from that date only, as held in MWO GS Dahdli @others Vs UOI case (CWP 6223/2007 passed by Div Bench of P&H HC Chandigarh on 26.8.08.
(c) Composition of revised pay Groups, revision of pay scales based on entry qualifications etc wef 10.10.97 was carried out vide your Orders No.1(26)/97d)Pay/ Services) d/d 03.10.2000 and 10.11.2000. My pay group III and scale was revised as Y group and the scale of pay was upgraded as 4320-85-5595 wef 10.10.97. (Authy SAFI 1/S/98). Therefore, the 50% formula applied on my pension, the same should have been Rs.2798/- w.e.f. 10.10.97. 50% DP merger in my pension w.e.f. 1.4.2004, be applied in my case, once the same is rectified on above lines.
7.   Based on the sequence of your pension policy/orders/guidelines, my BP should have been revised (appears to me the pensions mentioned in above PCDA Circulars (attached tables) suits (for No.of QS years e.g. 18.5+6 yrs =24.5 yrs in my case), to the revisions as follows:-
1.  29/30.11.1989     - Rs.713/- pm
2.  1.1.1996               - Rs.2158/- pm
3.  1.1.1996      - Rs.2296/- pm (Improved pension V CPC) (T 114 Cir 430)
4.  1.4.2004               - Rs.3444/- pm (With 50%DP)
5.  1.1.2006              - Rs.2296-(Without DP -as per Cir 430/-, Table 114)
6.  1.1.2006              - Rs.3444/-(with DP) as per Cir 430/-(T114)
7.   1.1.2006             - Rs.5190/- RP (as per Cir 430/- (T-114)
8.  1.7.06                  - Rs.6455/- RP  -do—(T-114)
7. 1.7.09                   - Rs.6914/- RP ( as per Cir 501- Table 17)
8. 24.9.12                 - Rs.7375/- RP (As per Cir 501 –Table 17)
9. 1.1.2006               - Rs.5837/- (as per Circular 547 Annx B)
8.    Kindly revise my pensions as above, which are applicable for total qualifying service of 18.5 years plus 6 years of weightage added, and order for release of arrears at an early date.

  1. Gavini you are effected . Like wise there are plenty of JCO/NCO/OR & their family pensioners effected . WHAT IS THE WAY FORWARD ?
    .1. These applications are of no use and give any result .
    .2. Try the Pension Adalat Route , they may rectify it wef 1/1/1996. Or May not
    .3. The only Sure shot win is through an AFT case .To reduce per head cost of Legal expenses , all of you guys , similarly effected get together and Fight it out in AFT-Delhi (where the incident has taken place ,and the MOD is located).

  3. Veteran Narayana, I was discharged with pension after 18 years of service in Nov 1984. I do not know to argue my case as you have done.       My father retired from IAF as CPL with 15 Yrs. 11 Day service on 31st 1988. He is not updated about his pensions. Please provide the details what this is all about.

    I searched all the available websites to find out the pay scales of PBOR applicable w.e.f.1/1//1986.We ,the PBORs used to have some type of separate pay scales unlike the CG employees.If any body is having that information ,I request him to send it to my Email ID : renganathstsri51@gmail.com.Without knowing the pay scale we can not calculate the pension exactly.Thanking you all

    Why there is no response given to OROP the injustice done for N/ SUB, JWO and CPO ?
    why? there is a huge difference between X and Y group JWO, see below.
    Group JWO WO (Hike, from JWO to WO )
    X Basic 10480 11615 = 1165 X GP
    Y Basic 8853 11150 = 2279 Y GP, why Y is given more than X

    Difference:1627 465 X & Y group JWO & WO,difference in Basic pension
    Y group JWO to WO 8853 – 11150 is 2279
    X group JWO to WO 10480 – 11615 is 1165
    If Y & X JWO’s difference is also brought down to that of Y & X WO’s i.e. 465, then a Y GP JWO’s Basic should be 10015. if this correction is done then the pension of Y & X group will tally, see below
    Group JWO WO (Hike, from JWO to WO )
    X Basic 10480 11615 = 1165 X GP
    Y Basic 10015 11150 = 1165 Y GP
    Difference: 465 465 it tallies for JWO’s & WO’s, i.e. on promotion from JWO to WO the hike is 1165 for Y & X and the difference of Y & X for both the ranks is same 465.
    Kindly do the required correction and do justice to Y group JWOs,
