REVISE PENSION OF PRE-2006 RETIREES BY MAY 31: MINISTRY

The Ministry of Finance has issued orders that pending cases concerning revision of pension consequent to the government removing the requirement of having 33 yrs service to earn full pension should be processed by May 31. The revision would increase the pension of the central employees concerned. The provision of having 33-year service for earning full pension was done away with in 2006 on implementation of the Sixth Pay Commission, but this benefit was not extended to pre-2006 pensioners and the pension in such cases was being calculated with the proportionate reduction. In April, orders were issued to bring them on par with post-2006 pensioners.Orders issued by the Central Pension Accounting Office on April 27 have directed all principal chief controllers of accounts, chief controllers of accounts, controllers of accounts, accountant generals and UT administrators to revise such cases by using e-revision applications available on official networks.Over 93,000 cases from 54 Central ministries and departments are pending for revision consequent to the April 6 order. The highest number (58,629) is from the Ministry of Home Affairs.

  2. Is this rule applicable to PSU banks. I was re-employed in a PSU bank as a clerk and retired as Deputy Manager on 30/04/2016. Since i had only 19 years of service in bank my retirement benefits limited to 33.33% of my last drawn pay. Will anyone of our veterans help me to get 50% of last drawn pay as pension as per the recent orders.

    1. 13. In view of the judgments of the Honble Supreme Court in D.S. Nakara (supra), V. Kasturi (supra), T.S. Thiruvengadam (supra) and order of the Full Bench of the Tribunal in OA 937/2010 with OA 2101/2010 dated 20.11.2014, we are of the opinion that the prayer in the OAs is fully justified. We, therefore, quash and set aside the impugned orders dated 3.10.2008 and 19.03.2010 being violative of law laid down by the Honble Supreme Court and direct the respondents that the qualifying service for earning full pension will be treated as twenty years also for those who retired from the Central Government service on or before 31.12.2005 and were alive on that day. The respondents are also directed to modify/amend all relevant government orders/ letters/ notifications in accordance with the above decision. It is made clear that this parity of pension between pre and post-1.01.2006 pensioners (on the question of eligibility of minimum pensionable service of twenty years) would apply both as regards pension and family pension. The respondents are granted three months time from the date of receipt of this order for implementation of directions contained in this order.

  11. Simply ! Universal .For all central govt persons .Def pers are in that category .
    Well ,MOD /DESW / PCDA would come out with print for execution / implementation. .
    Wait ,simply wait.
    Yes,they do take time - lot of time - more time ,unlike other ministries. Def is slow in this activity - they may be Swift in other areas of def related activities.
    Mod is manned by civilian staff. They do get their entitlements speedily, because files are moved and signed by them only - naturally.

  12. Ministry of Finance issued the letter on 06 Apr 2016 and the PCDA issued the circular c149 for payment of arrears to defence civilians on 08 Apr. Why could'nt the same PCDA issue the circular for ex servicemen? Do they require the MOD approval before giving anything to ex servicemen. The implementation as per MOF letter has to be done by 31 May. Without the circular the arrears wont be coming soon, so gentlemen unless we raise this issue with some hugh and cry things wont move.

  13. I am ex-sgt V S Rao Clk GD and served 15 years in IAF. Is this applicable for those less than 20 years of service? Also I served in SBI for 24 years sand getting my pro-rate pension as I have not completed 33 years of service? Is it applicable to public sector banks?
