MOD CLARIFICATION ON REVISION OF PENSION WEF 1.1.2006 (CIRCULAR MO. 547 DT.3.9.15 IN R/O OR/NCO/JCOs))

        Subject:  Revision of pension: MoD letter dated 3.9.2015.

Sir,

            I am directed to refer to email dated 4th September 2015  addressed to Hon’ble RRM regarding MoD letter dated 3/9/2015 issued in implementation of DoP&PW OM dated 30.7.2015 regarding benefit of fitment table in revision of pension with effect from 1.1.2006 instead of 24.9.2012, is placed opposite for kind perusal please. 

2.         It has been decided that with effect from 01.01.2006 pension/family pension of Pre-2006 JCOs/ORs Pensioners/family pensioners shall be determined as fifty and thirty percent respectively of the minimum of the fitment table for the Rank in the revised Pay Band as indicated under fitment tables annexed with 1/S/2008 and equivalent instructions for Navy and Air Force, plus Grade Pay corresponding to the pre-revised scale from which the pensioner had retired/discharged/invalided out/died including Military Service Pay and X group pay.

3.         However, in case, the consolidated pension/family pension calculated as per Para 4.1 of this Ministry's letter No. 17(4)/2008(1)/D(Pen/Pol) dated 11.11.2008 is higher than the pension/family pension calculated in the manner indicated above, the same (higher consolidated pension/family pension) will continue to be treated as basic pension/ family pension. Further, where revised pension in terms of GOI, MOD letter No.PC-10(1)/2009-D (Pen/Pol) dated 08.03.2010 and No. 1(13)/2012/D (Pen/Policy) dated 17.01.2013 is higher than the rate indicated in annexure attached with letter dated 3.9.2015 then the same will continue to be treated as basic pension/ family pension from 1.07.2009 and 24.09.2012 respectively.

4.         Accordingly, revised tables indicating minimum guaranteed pension/ Ordinary Family Pension has been annexed as annexure-A ( Army pensioners), Annexure -B (Air Force pensioners), and Annexure-C (Navy pensioners) to MOD letter dated 3.9.2015. 

5.         In view of the above, a pre 2006 JCO/ORs pensioner/ family pension will get pension as indicated in the table w.e.f 1.1.2006 

or as per MoD letter dated 11.11.2008 

or from 1.7.2009(only pensioner and not family pensioners) as per MoD letter dated 8.3.2010 

or w.e.f. 24.9.2012 as per MoD letters dated 17.1.2013 in respect of pensioners/ family pensioner of JCO/ORS

whichever is more beneficial.

  1. I was getting 4122 from 01.01.2006, 4955 from 01.07.2009 and 5416 from 23.09.2012. Sergeant Y Group. Will I now receive any thing ???

In the case of officers vide circular No 548 it has clearly been written the arrears shall be given wef 01.01.2006 on the bases of basic pension+DA wef 24.09.2012, but vide circular No 547 regarding jcos/or the language has totally changed with fitment table and no arrears is applicable to these category because we are bloody jcos/or, please clarify the arrears on the basis of pension getting wef 24.09.2012 is being given wef 01.01.2006 instead of 24.09.2012 as stated in favour of officers circular No 548.

      I am a civilian n son of an Ex-serviceman. I can suggest you please file an RTI online to the respective department and it cost's Rs.10 only. U can file it from your home on RTI Online website. Please pos the the RTI reply copy in this blog also

  4. Annexure A attached to the MOD letter shows same minimum guaranteed pension for Sepoy, Naik and Hav for their services 15 to 20 years. How this can be alright and this type has been avoided in Annexure B and C. Kindly clarify.

  5. MOD Letter no.1(13)/2012/D (Pen/Policy) dated 17.01.2013 does not carry 50% of minimum pension but existing pension. Circular 547 formula itself shows around 30% of minimum pension. PCDA is making us fool nothing else.So no arrears for PBOR.

  6. Can some one please make MOD CLARIFICATION ON REVISION OF PENSION WEF 1.1.2006 (CIRCULAR MO. 547 DT.3.9.15 IN R/O OR/NCO/JCOs)) more easier to understand? Please explain in detail so that everyone can understand and calculate the arrears. I would appreciate the efforts.

  7. Is the MOD actually read both the circulars 547 & 548 why is the disparities what the ESM organisations doing there. Why they not bring the case before MOD. Is there the officers sitting in MOD are blinds.How can they issue a clarification note.They fool us now also ( after retirement).

  8. There are no clear table shown about PCDA Allahabad circular number 547 shows lower than most are receiving, just like showing like illiterate peoples are sitting and making such Table I.e. begged.

    The Govt says more beneficial scale will be paid to the pebsioner. Now the problem is which scale to be taken to calculate the pension from 01.01.2006. When approached the bank they are also in confusion. Kindly clarify.

    I like to lay down few lines for your kind necessary action please.

    1. The Annexure ‘A’ (Army), ‘B’ (Air force) and ‘C’ (Navy) are not calculated as per the contents of para 2 of your letter No. 1(04)/ 2015 (II)-D(Pen/Pol) dated 3rd September 2015.

    2. The Enhanced rate / ordinary rate of family pension tables have been issued vide your letter No. 1(14) / 2012 / D (Pen/ Policy) dated 17th January 2013. The pensions have been shown correctly as per the contents of the letter..

    3. Government of India, Ministry of Personnel, PG & Pensions, Department of Pension & Pensioners' Welfare, 3rd Floor Lok Nayak Bhawan, Khan Market, New Delhi-ll0 003. letter No. F.No.38/37/08-P&PW(A) dated the 28th January, 2013 issued for Revision pension for Pre-2006 pensioners is also correctly worked out.

    4. I have served for 17 years 02 months in Army and retired as Sub Maj in the pay scale of 7250-200-10050.

    My basic pension fixed as on 31Mar 2001 - 3350

    Pension revised on 01.07.2009 as per GOI, MOD, DoESW letter - 7571
    No.17(4)/D(Pen/Policy) dated 11.11.08

    Basic pension revised as per GOI, MOD, - 8967

    Fifty percent of the minimum of the fitment table for the - 10845
    Rank in the revised Pay Band plus Grade Pay corresponding
    to the pre-revised scale from which the pensioner had retired
    including Military Service Pay and X Gp pay as per GOI, MOD,
    Deptt. of Ex-servicemen Welfare, New Delhi letter No
    1(04)/ 2015 (II)-D(Pen/Pol) dated 3rd September 2015
    works out to

    (Pre revised scale 7250-200-10050. 7250 x 1.86 = 13490

    13490 + Grade pay 4800 + MSP 2000 + ‘X’ Gp pay 1400 = 10845)

    The Enhanced rate / ordinary rate of family pension as per - 10845

    5. How come Service pension of JCOs/ ORs becomes less than Enhanced rate of family pension. The minimum pension should be Rs 10845 for Sub Maj ‘X’ Gp.

    6. Kindly issue corrigendum or amendment to your HQ letter No 1(04)/ 2015 (II)-D(Pen/Pol) dated 3rd September 2015.

    7. Tables attached with your HQ letter No 1(14) / 2012 / D (Pen/ Policy) dated 17th January 2013 shall made applicable for your letter No 1(04)/ 2015 (II)-D(Pen/Pol) dated 3rd September 2015

    8, Pension arrears have not been paid to me and affected persons till date due to wrong table attached with your HQ letter No 1(04)/ 2015 (II)-D(Pen/Pol) dated 3rd September 2015. Therefore I request your honour to take early action for true implementation of your order.
